The Caregivery community includes profiles, subjective ratings, feedback, comments, simple background checks and other informative details about the service providers. Caregivery is provided to You by Shiftspot, Inc. “Shiftspot”, and the following User Agreement governs Your access to and use of Caregivery including the profiles, subjective ratings, background check information, comments, materials and other informative details about the service providers and any other content (collectively, "Content") available on or through Caregivery.
USER AGREEMENTPLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCESSING, USING OR BROWSING CAREGIVERY OR ANY OF THE CONTENT.
BY ACCESSING, BROWSING OR USING CAREGIVERY OR ANY OF THE CONTENT, YOU, ON BEHALF OF YOURSELF OR YOUR ENTITY, AS APPLICABLE, ACKNOWLEDGE THAT:
1. YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS AND CONDITIONS OF THIS USER AGREEMENT;
2. YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS USER AGREEMENT;
3. THIS USER AGREEMENT IS THE LEGAL EQUIVALENT OF A SIGNED, WRITTEN CONTRACT BETWEEN YOU AND SHIFTSPOT; AND
4. IF ACCESSING, BROWSING OR USING CAREGIVERY OR ANY OF THE CONTENT ON BEHALF OF AN ENTITY, YOU HAVE FULL AUTHORITY TO BIND YOUR ENTITY TO ALL OF THE TERMS AND CONDITIONS OF THIS USER AGREEMENT.
IF YOU ARE NOT WILLING TO BE OR CANNOT BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION THE PRECEDING AGREEMENT AND ACKNOWLEDGEMENT, THEN DO NOT SELECT THE "I AGREE" BUTTON ASSOCIATED WITH THIS USER AGREEMENT OR ACCESS, BROWSE OR USE CAREGIVERY OR ANY OF THE CONTENT. MOREOVER, SHIFTSPOT DOES NOT AND WILL NOT GRANT YOU ANY RIGHT OR LICENSE TO ACCESS, BROWSE OR USE CAREGIVERY OR THE CONTENT WITHOUT YOUR WILLINGNESS AND ABILITY TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION THE PRECEDING AGREEMENT AND ACKNOWLEDGEMENT.
LICENSEYou agree by accessing, browsing or otherwise using Caregivery, Caregivery and the Content are and remain the sole property of SHIFTSPOT or third-party providers, as applicable. Except as expressly permitted by us in writing, You agree that Your license to access, browse and/or use this Content is limited solely to a personal, revocable, nonexclusive, non-transferable license to (i) access and view Caregivery and the Content, and (ii) copy, download and store the Content (e.g., in a temporary cache) to enable printing and/or offline viewing of such Content solely for Your non-commercial use and not for resale or distribution to anyone else. You also agree that, with respect to any copy of the Content that You download, store and/or print, You will reproduce and include all copyright and other proprietary notices included in such Content.
Except as expressly permitted by SHIFTSPOT in this User Agreement or otherwise in writing, You will not copy, reproduce, modify, adapt, translate, distribute, transmit, download, upload, post, sell, rent, license, transfer, publicly perform, publicly display, mirror, frame, scrape, extract, wrap, create derivative works of, reverse engineer, decompile or disassemble any aspect of this Caregivery or any of the Content, in whole or in part, in any form or by any means, whether manual or automatic. Further, You may not use any metatags, metaelements, "hidden text" or other equivalents using the names "," "SHIFTSPOT", www.Caregivery.com, "Caregivery," " Caregivery community," "Caregivery account," "Caregivery privacy policy" or any other colorable equivalent without the prior written permission of SHIFTSPOT.
ELIGIBILITYThe Caregivery site, services and membership plans are not available to the following:
a. minors under the age of eighteen (18)
b. anyone who attempts to work in a country that they are not legally permitted to do so.
c. anyone who has been convicted of a felony or any criminal offense characterized as a sexual offense.
Any misstatements and/or misrepresentations by any user or member of this site are not the responsibility of Caregivery. Site users and members are completely responsible and accountable for providing accurate and truthful information including but not limnited to age, personal background, criminal record, and work experience. Misstatements or misrepresentations of any users of this Site are not the responsibility of Caregivery does hereby disclaim any liability whatsoever for any misstatements and/or misrepresentations made by any site user.his Site.
SECURITY POLICYYour payment and personal information are always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read over the internet.
PAYMENT AND REFUND POLICYMembers that sign up for a Paid Subscription Plan, Premium Ad Listing or Lead Service agree to pay all charges for current, published prices at the time of their selection for any use of the Site. In addition, Members authorized their credit card or other payment account to be charged. If a billing issue or error arises, Caregivery is granted the right to make corrections even if payments were inaccurately received and processed.
The Paid Subscription Plan, Premium Ad Listing or Lead Service for members who have signed up for a Paid Subscription Plan, Premium Ad Listing or Lead Service will be automatically renewed for successive renewal periods of the same length as the original term originally selected by Member. The pricing and charges for automatic renewals will be for the current subscription rate for that plan. To change or cancel your subscription at any time, contact info@caregivery.com
There are NO REFUNDS or PRO RATED CREDITS for unused time if a member elects to cancel before the end of the Paid Subscription Plan, Premium Ad Listing or Lead Service Term. No refunds or credits will be provided for account cancellation requests received after the account has been billed.
